These Terms of Service (“Terms”) govern access to and use of the Focus on Foundations website, family account and learning services, and QRAG question-answering service (collectively, the “Services”).
1. Acceptance and Privacy Policy
By creating an adult or guardian account, accepting these Terms through the Services, or using the Services as an adult, you agree to these Terms and acknowledge our current Privacy Policy, which is incorporated into these Terms by reference. A minor may use the Services only with these Terms accepted on the minor’s behalf by a parent or legal guardian and under that guardian’s supervision. If you do not agree, do not use the Services.
When we make a material update, we will require an adult account holder or guardian to review and accept the updated Terms and Privacy Policy before continuing to use signed-in Services. A minor does not complete adult re-consent.
2. United States Family-Direct Beta Scope
The current beta is offered directly to families in the United States. Adult account self-signup is offered only to people age 18 or older in the United States. A parent or legal guardian may create and manage an account for a minor as described below.
The beta is not a school-directed service. Focus on Foundations does not currently offer school deployments, enter school contracts, or integrate school rosters or school-controlled education records. Focus on Foundations does not represent that it acts as a FERPA school official. Do not use the beta on behalf of a school or upload school-controlled education records. Any future school-directed or non-United States offering would require separate operational and legal review and, where appropriate, separate or updated terms.
These intended limits describe how the beta is currently offered; wording and operational scope do not by themselves conclusively determine which laws apply. Actual legal obligations depend on the facts and applicable law.
3. Guardian-Managed Minor Accounts
Only a parent or legal guardian with authority over a minor may create or manage the minor’s account. The guardian accepts these Terms on the minor’s behalf, supervises the minor’s use, controls the account credentials, provides any required consent, and is responsible for reviewing the minor’s use of the Services.
Children under 13 may not self-register. Minors may not accept adult re-consent themselves. The guardian can use available family controls to review, correct, export where offered, or delete the minor’s account and learning data, subject to the Privacy Policy and the technical limits described there.
4. Accounts and Security
You must provide accurate account and family information and keep it reasonably current. A guardian creating a child account must use a guardian-owned plus-address email, such as parent+child@example.com, that routes to the guardian’s inbox.
Keep credentials confidential and use them only for the account to which they belong. Do not share an adult account or allow another person to use it. A guardian may allow a child to use only the guardian-created child account that the guardian manages. Notify contact@focusonfoundations.org promptly if you believe an account or credential has been compromised.
5. Services and QRAG
The Services may include learning applications, family account tools, learning-data synchronization, account data export and deletion controls, and QRAG. Features may change during the beta.
QRAG questions and selected source context may be sent to OpenAI or Anthropic to generate a response. AI output may be inaccurate, incomplete, outdated, or misleading, so independently evaluate it. Do not include sensitive personal information, confidential information, school-controlled education records, or information you lack authority to submit in a QRAG question.
The adult account, family, guardian-created child account, and child learning-data store is not automatically sent to OpenAI, Anthropic, or another LLM provider. If a user is signed in, the current QRAG question and generated response may later be saved to signed-in history after the response is produced. Saving that history does not cause stored account, family, child learning data, or prior QRAG history to be automatically sent to an LLM provider.
6. Acceptable Use
You may use the Services only lawfully and in accordance with these Terms. You may not:
- Use the Services for unlawful, fraudulent, deceptive, threatening, exploitative, or harmful activity.
- Impersonate another person, misrepresent authority, harass others, or abuse the Services.
- Scrape, crawl, bulk-download, or use automated requests in a way that extracts the corpus, exceeds reasonable limits, or overloads or disrupts the Services.
- Bypass or attempt to bypass authentication, access controls, security measures, or rate limits.
- Introduce malware or other harmful code, or probe or interfere with the Services or supporting systems.
- Infringe intellectual property, privacy, confidentiality, or other rights.
- Attempt to access another account, family, child record, learning file, or other nonpublic data without authorization.
- Upload or submit content or data you do not have authority to use and provide.
7. User Content
You retain any rights you have in questions, files, learning inputs, and other content you submit (“User Content”). You grant Focus on Foundations a nonexclusive license to host, copy, process, transmit, display, and otherwise use User Content only as reasonably necessary to operate, secure, maintain, and provide the Services, comply with law, and exercise or enforce legal rights.
You are responsible for User Content and represent that you have the rights, permissions, and authority needed to provide it and permit this use. This limited license does not transfer ownership to Focus on Foundations and does not authorize us to sell User Content or use it for advertising.
8. Focus on Foundations and Third-Party Content
The Services, software, design, prompts, curated corpora, and other materials supplied by Focus on Foundations are owned by or licensed to us and are protected by applicable intellectual property laws. Subject to these Terms, we grant you a limited, revocable, nonexclusive, nontransferable right to use the Services for personal and family educational purposes during the beta. Separate open-source licenses govern code specifically released under those licenses.
Third-party excerpts, media, trademarks, and other materials remain subject to their owners’ rights and any applicable licenses or legal limitations. Links to third-party sites or services are provided for convenience; Focus on Foundations does not control or endorse their content, availability, privacy practices, or terms.
9. Beta Availability, Changes, and Termination
The Services are experimental and may contain errors or interruptions. We may add, change, limit, suspend, or discontinue beta features, and we do not promise uninterrupted availability or that a feature will remain available.
We may suspend or terminate access when reasonably necessary to protect users or the Services, comply with law, respond to suspected misuse or a security issue, or address a violation of these Terms. You may stop using the Services at any time and may use available account controls to export eligible data or delete an account.
Export data you wish to retain before requesting deletion or losing access. Deletion is intended to remove applicable current account records and user files and may be irreversible; limited records may remain temporarily in provider backups or recovery systems, or when narrowly necessary for legal or security purposes, as described in the Privacy Policy. Suspension, termination, feature changes, or discontinuation may limit later access to or export of data.
10. Educational and Informational Use
The Services and their outputs are for educational and informational purposes only. They are not legal, medical, financial, mental-health, safety, or other professional advice and are not a substitute for a qualified professional. AI-generated and source-derived material may contain errors. You are responsible for deciding whether and how to rely on it and for providing appropriate adult supervision.
11. Disclaimers
To the extent permitted by law, the Services are provided “as is” and “as available,” without express or implied warranties, including warranties of accuracy, reliability, availability, merchantability, fitness for a particular purpose, title, or noninfringement. We do not warrant that the Services will be uninterrupted, secure, error-free, or suitable for a particular learning outcome.
These disclaimers do not exclude warranties or rights that cannot lawfully be excluded.
12. Limitation of Liability
To the extent permitted by law, Focus on Foundations and its directors, officers, employees, volunteers, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the Services or these Terms.
Nothing in these Terms limits liability or remedies that cannot be limited under applicable law, and nothing waives nonwaivable consumer, privacy, child-protection, or other statutory rights.
13. Indemnification
To the extent permitted by law, an adult user or guardian agrees to indemnify and hold harmless Focus on Foundations and its directors, officers, employees, and volunteers from third-party claims, damages, and reasonable costs arising from that user’s unlawful use of the Services, User Content submitted without required authority, or material violation of these Terms. This obligation does not apply to the extent a claim results from conduct for which indemnification cannot lawfully be required.
14. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, subject to any mandatory law or nonwaivable rights that apply to you.
15. Changes to These Terms
We may update these Terms as the beta and our practices change. We will post the revised Terms and update the effective date. For a material update, we will provide additional notice and require the adult account holder or guardian to re-consent. If you do not agree to updated Terms, you must stop using the affected Services.
